Social Media Defamation Case Successfully Resolved

A Johor Bahru business owner defamed on Facebook obtained a public apology, damages and permanent removal of the offending posts.

The Situation

Madam S, the owner of a well-established catering business in Johor Bahru, discovered that a former client had posted a series of defamatory statements on Facebook and in a local consumer complaint group. The posts alleged that Madam S's catering had caused food poisoning at a large event, that her business operated without proper hygiene certification, and that she had fraudulently charged for services not rendered. The posts were accompanied by photographs of the event and had been shared over 200 times, attracting numerous negative comments. Within days, Madam S received cancellations from three regular corporate clients and several prospective customers cited the Facebook posts as the reason for withdrawing their bookings.

The Legal Challenge

Online defamation spreads rapidly and can cause immediate, measurable damage to a business's reputation and revenue. Under the Defamation Act 1957, the posts constituted libel as they were published in permanent form on a digital platform. The key challenge was to act quickly to limit the ongoing damage while building a case for damages. The defendant initially claimed the posts were honest consumer feedback protected by fair comment. However, the allegations regarding food poisoning and fraudulent charging were assertions of fact, not opinion, and were demonstrably false. The defendant had not reported the alleged food poisoning to any health authority, and the health certificate for Madam S's business was current and valid.

Our Approach

Our defamation lawyers acted within 48 hours. We obtained an interim injunction from the High Court restraining the defendant from publishing further defamatory statements and compelling the removal of the existing posts pending trial. The injunction application was supported by an affidavit exhibiting screenshots of the posts, the share count and comments, cancellation emails from clients, and the business's valid health certification. We simultaneously sent a letter of demand to the defendant requiring a public retraction, apology, undertaking not to repeat the statements, and payment of damages. We also wrote to Facebook (Meta) requesting removal of the posts under their content policies.

The Outcome

Faced with the injunction and the strength of Madam S's evidence, the defendant agreed to settle before trial. Under the settlement terms, the defendant posted a full public apology on the same Facebook group and on her personal profile, acknowledging that the allegations were false and that Madam S's business operated in full compliance with health regulations. The defamatory posts were permanently removed. The defendant paid RM35,000 in damages plus Madam S's legal costs. The apology remained on the defendant's profile for a period of 90 days. Madam S's business reputation recovered within months, and the two corporate clients who had cancelled resumed their bookings after the apology was published.

Key Takeaways

Speed is the most critical factor in online defamation cases. Content that goes viral can cause irreversible reputational damage within hours. An interim injunction, while requiring the claimant to demonstrate a serious question to be tried and that damages would not be an adequate remedy, is a powerful tool to stop the spread of defamatory content immediately. The distinction between statements of fact (which must be true to be defensible) and statements of opinion (which may be protected by fair comment) is crucial. Businesses should monitor their online presence regularly, document any defamatory content with screenshots before it is removed, and seek legal advice without delay. At Messrs S K Song, we understand the urgency of reputation protection and are equipped to act swiftly on your behalf.
